Twitter deve fornire i dati di Occupy Wall Street

Twitter è stato recentemente sconfitto in aula in merito ad una battaglia che rischia di avere pesanti ripercussioni sull’attivismo in rete: Malcom Harris, il manifestante denunciato a New York per aver bloccato il traffico durante Occupy Wall Street, non è stato ritenuto proprietario costituzionalmente garantito dei suoi tweet.

A decretare ciò è stato il giudice Matthew Sciarrino che, appunto, ha disposto la fulminea trasmissione dei dati di Harris respingendo quindi la mozione che Twitter aveva inizialmente opposto.

La mozione in questione era stata presentata all’attenzione di un giudice di New York nel tentativo di poter combattere l’ordinanza in base alla quale i responsabili di twitter avrebbero dovuto consegnare tutti i dati utili all’identificazione dell’utente coinvolto nel movimento di protesta.

Il giudice Sciarrino ha però sottolineato come la consegna delle informazioni in questione, quali indirizzo IP, attività di login e messaggi inviati e ricevuti, non vada a configurarsi come una violazione della privacy personale ragion per cui il Procuratore Distrettuale di New York potrà ora studiare in maniera dettagliata la gestione dell’account di Malcom Harris.

Per il giudice Sciarrino, infatti, pubblicare un tweet è, praticamente, come urlare alla finestra il che sta a significare che un tweet pubblicato viene considerato come una comunicazione al pubblico e quindi non appartenente alla sfera del privato.

Il giudice ha quindi autorizzato le autorità locali a visualizzare tutti i messaggi inviati e ricevuti da Harris tra il 15 settembre e il 31 dicembre 2011 e dall’account in questione pare siano stati inviati diversi incitamenti al blocco totale del traffico ignorando quindi l’ordine della polizia per evitare il caos nel corso di Occupy Wall Street.

Nonostante ciò la questione non sembrerebbe essere stata ancora chiusa: il fatto che il ricorso di Twitter è caduto non significa che l’iter sia già terminato ed infatti altre associazioni, come ad esempio l’ACLU (American Civil Liberties Union) e gli avvocati stessi di Harris stanno valutando le ulteriori possibili opzioni per il ricorso legale.
