Un buon motivo per non iscriversi a Pinterest

Tutti usano Pinterest, ma quasi nessuno si è preso la briga di leggere con attenzione i termini di utilizzo del social network. Invece, proprio nel caso di Pinterest, è consigliabile dare un’occhiata approfondita ai Terms of Use prima di aprire un account, perché ci sono alcune cose che non tornano.

Pinterest è un sito che appartiene alla società Cold Brew Labs, dove puoi postare anzi “pinnare” le immagini che trovi in giro per la rete su una o più bacheche virtuali chiamate “boards”, e raggruppare le foto che ti piacciono di più sotto i temi più svariati. Tu per esempio puoi creare una board dedicata interamente alle scarpe, e un’altra con tutte le foto del mio cantante preferito. Ma prima di cominciare è bene che tu sappia che quando ti iscrivi a Pinterest accetti automaticamente di attenerti ai termini di utilizzo del network, che sono piuttosto ambigui.

Nell’insieme di norme che regolano i Terms of Use di Pinterest, elencato come Member Content ho trovato questo:

You acknowledge and agree that you are solely responsible for all Member Content that you make available through the Site, Application and Services. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of all Member Content that you make available through the Site, Application and Services or you have all rights, licenses, consents and releases that are necessary to grant to Cold Brew Labs the rights in such Member Content, as contemplated under these Terms; and (ii) neither the Member Content nor your posting, uploading, publication, submission or transmittal of the Member Content or Cold Brew Labs’ use of the Member Content (or any portion thereof) on, through or by means of the Site, Application and the Services will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

Per farla breve, il paragrafo dice che quando posti una foto su Pinterest dichiari che sei l’unico e solo proprietario di quell’immagine, o di aver ricevuto espressamente il consenso del proprietario alla pubblicazione, e di conseguenza di non stare violando nessun copyright.

È fondamentale che il copyright sia tuo, perché solo così Pinterest può vendere tutto quello che hai pinnato.

Facciamo un esempio: tu hai pinnato qualcosa che non è tuo, magari proprio la foto del tuo cantante preferito ma scattata da un famoso fotografo. La foto è bella e Pinterest se la rivende. Allora il suddetto fotografo decide di far valere il diritto alla proprietà intellettuale e chiede un indennizzo alla Cold Brew Labs. La società a questo punto se ne lava le mani perché tu hai dichiarato di essere l’unico e solo proprietario della foto. Così alla fine ti ritrovi da solo a pagare i danni e tutte le spese legali.

Ti sembra un’esagerazione? Forse hai già dimenticato cosa è successo con la chiusura di Megaupload.

    Rubies are often referred to as the ‘king of gemstones’

    According to Melee the Show founders Lauren Wolf and Rebecca Overmann, ruby jewelry is on the rise.

    The fine jewelry trade show connects buyers and designers, with the next shows taking place
    in New York (February 1-3) and Tucson (February 5-7).

    The limited-edition collection is a part of Big Bang’s fine jewelry program called Love Mine, it includes three exclusive pieces as
    part of the Dara Kaye Jewelry for Big Bang capsule collaboration collection. 

    The pieces all feature sustainably sourced, cultured
    lab grown stones. 

    ‘For the centerpiece, we chose a ruby heart—a timeless symbol of love, designed to be worn close to
    the heart,’ says Dara Kaplan, designer of Dara Kay Jewelry.

    The collections consists of the Gran Amor Heart Pendant, a large Ruby heart encircled with Diamonds that

  18. Lady Gaga is set to release her seventh studio
    album in February.

    Despite lead single Disease stalling on the Hot 100 at No.
    27, the 38-year-old is forging ahead with her next album, which she described as both ‘fun’
    and ‘darker.’

    Speaking to Vogue magazine about the project, Gaga said that she’s been focused on the production side of her new songs. 

    ‘I love producing — I always have — and something that was really important to me making
    my seventh studio album was blending live instrumentation with programming,’ she explained.

    ‘The album is chaotic from a genre perspective — it is genre-bending, and
    I think in that way is a deeply personal look into my mind as a producer and the way I think about music.’

    She also said that the album has a ‘darker pop’ sound that’s
    more in line with her iconic 2009 album, The Fame Monster. 

    However, fans need not be worried that Gaga is going too somber with her sound. 

    ‘The album is not extremely serious in that it’s very fun and meant to be enjoyed at a party, in a club, or at home having
    personal fun time — to be free of your worries at home or
    walking through life,’ she insisted.

    single Disease

    Gaga released the album’s lead single Disease last month to rave reviews
    from music critics, who lauded it as a return to
    the star’s roots.

    Unfortunately, the acclaim failed to translate to the charts, with Disease debuting at No.
    27 on the Hot 100 – her worst entry for a lead single in 16 years.

    On the bright side, Gaga is currently enjoying one of her biggest
    hits in years thanks to her Bruno Mars duet, Die With a Smile. 

    The ballad has so far reached No. 2 on the Hot 100
    and No. 1 on the Pop Airplay Chart.
