Un buon motivo per non iscriversi a Pinterest

Tutti usano Pinterest, ma quasi nessuno si è preso la briga di leggere con attenzione i termini di utilizzo del social network. Invece, proprio nel caso di Pinterest, è consigliabile dare un’occhiata approfondita ai Terms of Use prima di aprire un account, perché ci sono alcune cose che non tornano.

Pinterest è un sito che appartiene alla società Cold Brew Labs, dove puoi postare anzi “pinnare” le immagini che trovi in giro per la rete su una o più bacheche virtuali chiamate “boards”, e raggruppare le foto che ti piacciono di più sotto i temi più svariati. Tu per esempio puoi creare una board dedicata interamente alle scarpe, e un’altra con tutte le foto del mio cantante preferito. Ma prima di cominciare è bene che tu sappia che quando ti iscrivi a Pinterest accetti automaticamente di attenerti ai termini di utilizzo del network, che sono piuttosto ambigui.

Nell’insieme di norme che regolano i Terms of Use di Pinterest, elencato come Member Content ho trovato questo:

You acknowledge and agree that you are solely responsible for all Member Content that you make available through the Site, Application and Services. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of all Member Content that you make available through the Site, Application and Services or you have all rights, licenses, consents and releases that are necessary to grant to Cold Brew Labs the rights in such Member Content, as contemplated under these Terms; and (ii) neither the Member Content nor your posting, uploading, publication, submission or transmittal of the Member Content or Cold Brew Labs’ use of the Member Content (or any portion thereof) on, through or by means of the Site, Application and the Services will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

Per farla breve, il paragrafo dice che quando posti una foto su Pinterest dichiari che sei l’unico e solo proprietario di quell’immagine, o di aver ricevuto espressamente il consenso del proprietario alla pubblicazione, e di conseguenza di non stare violando nessun copyright.

È fondamentale che il copyright sia tuo, perché solo così Pinterest può vendere tutto quello che hai pinnato.

By making available any Member Content through the Site, Application or Services, you hereby grant to Cold Brew Labs a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such Member Content only on, through or by means of the Site, Application or Services.

Se il copyright non è tuo, allora vuol dire che hai infranto i diritti proprietari di terzi, e la responsabilità non è di Pinterest, ma soltanto tua.

Facciamo un esempio: tu hai pinnato qualcosa che non è tuo, magari proprio la foto del tuo cantante preferito ma scattata da un famoso fotografo. La foto è bella e Pinterest se la rivende. Allora il suddetto fotografo decide di far valere il diritto alla proprietà intellettuale e chiede un indennizzo alla Cold Brew Labs. La società a questo punto se ne lava le mani perché tu hai dichiarato di essere l’unico e solo proprietario della foto. Così alla fine ti ritrovi da solo a pagare i danni e tutte le spese legali.

Ti sembra un’esagerazione? Forse hai già dimenticato cosa è successo con la chiusura di Megaupload.

    Scientists are harnessing the power of artificial intelligence to detect hidden archaeological sites buried below the sand of the sprawling Rub‘ al-Khali desert.

    The desert spans 250,000 square miles (650,000 square kilometers) on the Arabian Peninsula, and its name translates to “the Empty Quarter” in English. To unravel the secrets of the desolate terrain, researchers are combining machine learning with a satellite imagery technique that uses radio waves to spot objects that may be concealed beneath surfaces.

    The technology will be tested in October when excavations assess whether predicted structures are present at the Saruq Al Hadid complex in Dubai, United Arab Emirates.

  46. Star Entertainment has posted a $1.7 billion loss after writing down the value of its three casinos by $1.44 billion, and says it is cutting hundreds of roles to weather a significant short-term cash crunch.

    The troubled gaming company on Thursday announced it was writing down the Star Sydney by $337 million, the Star Gold Coast by $274 million, and its half-owned Queens Wharf project in Brisbane by $819 million.

    “The impairment has arisen from the impact of challenging trading conditions as well as various recent and upcoming regulatory changes which are expected to negatively impact the earnings of the business,” the Star announced on Thursday afternoon.

    The company’s revenue was down 10 per cent to $1.68 billion, which the Star said reflected challenging trading conditions due to cost-of-living pressures as well as casino operating reforms and loss of market share.

    Trading deteriorated in the second half and that trend has continued into the new financial year, with the Star estimating it lost $6.6 million in earnings before interest, tax, depreciation and amortisation (EBITDA) in July, a month during which it turned off gaming machines for three days to address tech issues and lost another 24 hours of business due to the global Crowdstrike outage.

    In August, Star lost $1.1 million in EBITDA. 

    Main gaming floor revenue continues to be robust, but that hasn’t been sufficient to offset declines across private gaming rooms, where high-rollers play.

    “There are a number of significant challenges currently facing the business from an earnings, liquidity and balance sheet perspective,” Star Group chief executive Steve McCann said.

    The Star plans to reduce its headcount by the equivalent of 350 full-time roles by March and is enacting a hiring and salary freeze in a bid to save $100 million a year.

    The Star had $130 million in available cash as of August 31, but faces significant near-term liquidity requirements including funding its operations, remediation activities, contributions to the Queens Wharf joint venture and outflows related to ongoing regulatory matters.

    Earlier on Thursday the Star announced its corporate lenders had committed to loaning it up to another $200 million at an interest rate of 13.5 per cent.

    All but $34 million of the casino group’s $334 million in existing debt has also been repriced at that moderately high rate, reflecting concerns about Star’s financial viability.

    The sale of Star’s Treasury Brisbane Casino property to Griffith University is expected to close on Friday and provide Star with a net cash injection of $60.7 million.  

    It is reviewing the potential sale of other non-core cash assets, including the Treasury hotel and car park, which are not being sold to Griffith University.

    Combined those assets have an estimated cash value of at least $300 million.

    The Star had planned to release its financial statements at the end of  August, when they were due, but that was delayed for weeks after a NSW inquiry known as the Bell Two Report found the company was still unsuitable to hold a NSW casino license.

    The NSW Independent Casino Commission is considering the report’s findings. 

    The first Bell report, led by solicitor Adam Bell, found in 2023 that Star had serious governance and cultural issues that had allowed its casino to be used for money laundering, among other issues.

    The Star’s shares have been suspended on the ASX because of the delayed financial report.

    Separately on Thursday, Queensland Premier Steven Miles said talks with Star on possible tax relief had hit a stalemate over the issue of executive compensation.

    “There will be no consideration of any kind of arrangement while their executives insist on paying themselves performance bonuses,” Mr Miles said.

    The premier called it “astounding” that Star would ask the state to defer taxes while paying its executives performance bonuses that he said reportedly run into the tens of millions of dollars.

     Star declined to comment on the matter.
