Facebook: ragazzi fate attenzione a chi insultate

Molte volte sui social network è facile prendere di mira qualcuno e prenderlo in giro. Nel mondo dei giovani è facilissimo, soprattutto con i commenti relativi alle foto del povero mal capitato. Purtroppo bisogna fare i conti anche con la realtà: è stata questa la dura lezione che 9 studenti di Cagliari hanno capito oggi: 6 giorni di allontanamento dalle lezioni, di cui 4 dedicati ai lavori socialmente utili e nove ammonizioni. Tutto ciò a causa di un gruppo fondato da uno di essi, ove il tema principale di tutte le discussioni era l’ingiuria verso un povero docente. Dopo la scoperta del gruppo in questione, l’insegnante ha immediatamente discusso con i suoi colleghi dell’accaduto in un consiglio di classe, ed è stato deciso di punirli ma non di denunciarli legalmente.

Possiamo proprio dire che nonostante la “bravata” i nove se la sono cavata bene. Si perchè scrivere ingiurie contro terzi su internet è reato e può essere punito dalla legge. Molti credono che non saranno mai riconosciuti e nessuno potrà scoprirlo, soprattutto nelle conversazioni chat, ma si sbaglia. Difatti per i gestori di questi servizi è semplicissimo risalire all’ip di colui che fa tali cose e segnalarlo direttamente alla polizia postale. Non pensate che tutti stanno allo scherzo, le community e i social network sono pieni di “teste calde” pronte a difendersi e a querelarvi se esagerate.

In nel caso di oggi, il tutto è stato reso ancora più semplice in quanto su Facebook vengono espressamente citati tutti quanti i dati relativi al possessore del profilo. E anche se non autentico, la polizia postale può lo stesso rintracciarvi.

Che cosa si intende per ingiuria? E’ il delitto previsto e disciplinato dall’articolo 594 del codice penale ai sensi del quale:

Chiunque offende l’onore o il decoro di una persona presente è punito con la reclusione fino a sei mesi o con la multa fino ad euro 516. Alla stessa pena soggiace chi commette il fatto mediante comunicazione telegrafica o telefonica, o con scritti o disegni, diretti alla persona offesa. La pena è della reclusione fino ad un anno o della multa fino ad euro 1.032, se l’offesa consiste nell’attribuzione di un fatto determinato.

Scusate volevo sapere un informazione se uno si crea un falso profilo e manda con quel profilo messaggi ingiuriosi, con la eliminazione definitiva dell’account si elimina anche l’indirizzo ip dal quale la polizia postale risale poi alla vera identità oppure rimane lo stesso ed è suscettibile di denuncia?
