Stando ad una recente sentenza del giudice del tribunale di Livorno il già grave reato di diffamazione che, per chi non lo sapesse, in Italia può essere sanzionato anche con la detenzione in carcere, risulta aggravato qualora portato avanti anche mediante risorse di social networking, prima tra tutte Facebook.

Questo, in alteri termini, sta a significare che un delitto di diffamazione condotto online e su piattaforma social verrebbe aggravato dall’aver arrecato offesa sfruttando un mezzo pubblicamente accessibile e, di conseguenza, paragonabile al medesimo reato effettuato mediante mezzo stampa.

La decisione del giudice è stata presa in seguito al caso di una donna di 27 anni che dopo essere stata licenziata dal centro estetico per il quale lavorava ha poi sfruttato il proprio account Facebook per pubblicare e diffondere affermazioni offensive contro l’azienda per la quale operava e contro il datore di lavoro.

Tenendo conto di ciò, la sentenza, oltre ad assegnare una sanzione pari a ben 1000 euro all’imputata, ha anche stabilito che gli insulti espressi mediante risorse di social networking sono da considerarsi dannosi al pari di quelli “tradizionali” e che anzi risultano ancor più gravi e pericolosi poiché la loro diffusione avviene in maniera ben più immediata ed è potenzialmente priva di controllo.

La questione, riflettendo, assume poi ancor più rilevanza se si considera che in tal modo l’utilizzo di Facebook così come di ogni altro social network diviene ancor di più parte integrante della vita degli individui.

La sentenza, infatti, distrugge ulteriormente quel muro piazzato inizialmente tra vita sociale reale e vita sociale virtuale miscelando le due realtà e facendoci prendere coscienza del fatto che oramai tra l’una e l’altra non vi sono barriere e che, piuttosto, si tratta sempre più di due universi tra loro complementari.

Vita reale e vita virtuale a parte è poi opportuno sottolineare il fatto che tale sentenza avrà senz’altro non poche ripercussioni sugli internauti e, sopratutto, sulla libertà d’espressione in rete.
